          I.           Equipment 

 

              If your cake requires equipment such as columns, cake plates or a stand, a security deposit must be left with us at the time of final payment in order to ensure safe return of the equipment.  We will return this security deposit when the equipment is returned to us in original condition, no later than one week after the event date.  The security deposit is forfeited, without further notice, if equipment is not returned by ‘Equipment Return Date’ below.

         II.           Payment and Holding date

 

 a.           Orders that total $250.00 or less are required to be paid in full  before work begins. A reserved event date can only be held once deposit has been made, or paid in full. If not paid in full 10 days before the event or 30 days prior to the wedding date, the original date cannot be held or guaranteed. Orders totaling more than $250.00 will require a 50% deposit before any work begins, with the remaining balance due and owing in full no less than 10  days before the event date, 30 days prior to wedding dates ,or maybe paid in full upfront. Should the order not be paid in full on or before 10 days before the event date,or 30 days for the wedding event, the 50% deposit is waived and is non-refundable and date is released for other orders.

b.             Partial refunds will only be given in the event that your order is damaged by our employees upon delivery or setup at the venue. Batch Of Buttercream LLC employees will no longer be responsible for any damage that may occur while in your possession, after delivery and setup ie: accident, recklessness, horse play, or individual misconduct. If for any reason you are unhappy with your order, another complimentary cake will be provided for the event of your choice not to exceed 30 servings. 

 

c.            We are not responsible for any damage to the cake after setup is complete.  You are responsible for providing an appropriate and secure table and environment for the order(s).   Cakes in particular, are heavy and require a sturdy table, and optimal room temperature of 74 degrees or below. 

 

III.          Modifications to Order

The date of your final payment is the final date for any changes of size, style, or flavors of your order.  Any changes requested after this date cannot be guaranteed and may be subject to additional charge.

 

 

IV.           Other Provisions

 

a.              If flowers are provided, we will arrange up to 25 stems  $1 for each  stem.  You acknowledge                     that fresh flowers are not a food product, and may contain pesticides, insects, dirt, or other                       contaminants.

 

b.              If you or your representative elect to pick up and set up the cake, you assume all liability and                   responsibility for the condition of the cake once it leaves Batch Of Buttercream LLC’s actual                   possession.

 

c.              On occasion we will photograph our cakes and we reserve the right to use any photographs                       for display or promotion without compensation to you.

 

d.              Our products may contain or come into contact with milk, wheat, soy, and other allergens.                       You agree to notify your guests of this risk, and hold us harmless for allergic reactions.

 

e.             Performance of this agreement is contingent upon the ability of (Batch Of Buttercream LLC)                   to complete the Agreement and is subject to accidents, acts of God, and other causes beyond                     our control.

 

By proceeding with your order, you agree to the terms set out in this contract and agree that you are the person responsible for all payments and decisions regarding this order.  A copy will be sent to provided email and again with physical delivery of your items.
